Scheme Structure and Administration

Providing cover in public and products liability and professional indemnityHistory

Civic Mutual Plus began operating on 30 September 1993, providing a self-insurance fund for local authorities in Victoria. It provides cover in public and products liability and professional indemnity.

Its establishment grew from an unstable situation, characterised by a diminishing number of underwriters prepared to write local government business, premiums that could rise or fall dramatically from year to year and a cover that was inadequate in times when litigation was increasing in the community and councils were becoming more entrepreneurial.

Tasmanian councils were invited to join CMP in June 1996.


Legal Basis

In 1993 amendments were made to the Municipal Association Act 1907 directing the Association to establish a self-insurance liability scheme to provide public liability and professional indemnity insurance for the benefit of:
(a) the Association,
(b) any council under the Local Government Act 1989, and
(c) any other body established for local government purposes.

The Local Government Act 1989 was amended to allow councils which participated in an approved self insurance scheme to automatically comply with the minimum insurance requirements under section 76A(1) of the Act. However, a council is not compelled to be a member of CMP – membership is, and always has been, voluntary.

The scheme was formed under a Deed of Establishment, which is the official agreement between the Municipal Association of Victoria, Jardine Lloyd Thompson, and member councils who agree to be bound by the terms of this deed. The deed confirms the terms, conditions, obligations and benefits of the membership of each individual council/member.

CMP complies with the Insurance Act 1984 and, as far as is practicable, complies with the APRA Regulations.



Administration and Management

The MAV Insurance Committee acts as a committee of management and an advisory body to the MAV Board on the insurance, financial and other matters impacting on the scheme. While the committee is accountable to the MAV Board, it has delegated powers to administer the scheme on behalf of all members for each insurance year. The committee operates in accordance with a set of rules approved by the MAV Board.

Given the scope and highly specialised nature of CMP's operations, the MAV elected to contract a scheme manager to administer the scheme. Through a process of competitive tendering, Jardine Lloyd Thompson (JLT) was appointed as the Scheme Manager.
